Bankruptcy lawyer Chicago Fonfrias talks about hiring a bankupcy attorney

havingfun200 asked:

www.chicagomoneylawyer.com Everyone has the right to represent themselves if they want to, however, in any legal case but in a bankruptcy especially, there are a lot of landmines. I’ve seen people represent themselves and put themselves in the wrong chapter of bankruptcy. Example of this is the person didn’t want to hire an attorney, they went ahead and filed a chapter 7 on their own, of course not knowing that their home, because it was paid in full, put them over their exemptions and the chapter 7 trustee took their home and sold it and that person had equity of $250000. I don’t recommend filing bankruptcy on your own, I recommend seeking out an attorney that specializes in the area because you can do yourself more harm than good.

Is it possible to change from a chapter 13 to a chapter 7?

We have completed our first of five years of a chapter 13. Unfortunately, our marriage is not doing well and we are separating. I am hoping things can work out, but if not, is it possible for us to switch to a chapter 7 and get a complete fresh start so we can both be able to walk away from everything and start over? It is in the State of Ohio.

What happens to my foreclosed mortgage debt if I switch from Chapter 13 to Chapter 7 bankruptcy?

In Jan. 2008 I filed Ch. 13 in a frantic attempt to keep my home. In the end, I ended up losing the property due to raising ARMs. I am still in the Ch. 13 and am wondering if I couldn’t switch to a Ch.7 instead? If I do switch to a chapter 7 can my mortgage debt be included in the Chapter 7 or can they go after the co-signor at that point?

How often can someone file a chapter 13?

We are having a discussion here and we were talking about chapter 7 and chapter 13. My friend says that there is no limit on how often a chapter 13 can be filed.
